Texas Wildfire Damage

Texas Wildfire Lawyer

Wildfires have become more frequent in Texas over the last decade because of the drought conditions visited upon the central and western parts of the state. These have often produced devastating losses for home and land owners in the affected areas.Frequently, the source of the fire is untraceable, but when it can be determined, liability for the ensuing losses can be imposed on those who started the fire or negligently permitted it to spread from the source to the damaged properties.

THE WILDERNESS RIDGE FIRE, Bastrop, Texas, February 28, 2009:

This fire destroyed 28 homes and more than 1400 acres of land, including large swaths of the Lost Pines Forest.

The Rider Law Firm represents 23 families who lost homes, other structures, personal property, vehicles and acres of trees in claims against BluebonnetElectric Cooperative and its right of way clearance company, McCoy Tree Surgery, pending in the 335th District Court of Bastrop County. The case is set for trial on January 9, 2012. It is alleged in that lawsuit that Bluebonnet negligently maintained its transmission equipment in a forested area such that two conductors could come together to spark a fire, and further that it and its ROW maintenance company had failed to remove combustible materials and ladder fuels from the right of way in order to prevent a flash fire from growing into and spreading as a wildfire in the canopy of the heavy forest.

The BASTROP COMPLEX FIRE of September 4, 2011, has destroyed more than 1000 homes and more than 30,000 acres of grasslands and forest in Bastrop County. Many of the landowners and businesses affected by the fire will be entitled to damages from their own insurance companies and, perhaps, from other parties who may be determined responsible for causing the fire, after a complete investigation has been conducted by the authorities. The Rider Law Firm is already representing such persons affected by the fire and will be involved in the investigation.
